I-9, E-Verify, and Immigration Issues for Construction Professionals

November 3

Navigate immigration enforcement, Form I-9, and E-Verify compliance issues affecting the construction industry.

This webinar will provide construction employers, contractors, and business leaders with practical guidance for navigating immigration compliance issues affecting the construction industry. Attendees will learn how recent immigration enforcement activity may impact jobsites and workforce operations, what employers should know if ICE arrives at a construction site, and the Fourth Amendment protections and steps employers should take when responding to enforcement activity.

Because the Form I-9 obligation generally applies to employees rather than independent contractors, we will discuss how worker classification affects I-9 obligations and why this issue is especially important in the construction industry. The presentation will also cover general Form I-9 compliance, common mistakes that may lead to penalties, when reverification is required, how automatic EAD extensions may affect continued employment, and what E-Verify obligations may apply. We will also discuss recent developments affecting Temporary Protected Status (TPS) and DACA and how those changes may affect the workforce.

Learning Objectives

  • You will be able to identify employer rights, protections, and what to do when ICE arrives at a construction site.
  • You will be able to recognize how worker classification affects Form I-9 obligations in the construction industry.
  • You will be able to determine when employment authorization must be reverified.
  • You will be able to distinguish between voluntary and required E-Verify use.
