Flood Control and Stormwater Issues and the Law

Stormwater and flooding comprise major and growing risks to cities, transportation systems, people, and the environment.

Flooding is the major cause of property damage in the U.S., and catastrophes such as hurricanes Harvey, Irma, Sandy and Katrina have increased losses to unprecedented levels. Stormwater management has expanded to include organization of utilities, rain tax politics, consent orders, and green infrastructure. In response to increasing damages, liability, and climate change, stormwater and flood laws have evolved to complex statutes and cases. The National Flood Insurance Program relies on federal bailouts, and many changes are afoot to bring it under control. Local government responsibilities must be financed by ratepayers. Homeowners are often in a quandary about their risks and losses. The increasing complexity and importance of stormwater and flooding programs create new responsibilities and opportunities for individuals, governments and businesses. Learn how stormwater and flood risks are increasing due to decisions of individuals, businesses and governments. The legal aspects of stormwater and flooding will be explained through doctrines, statutes, and cases. Major issues of floodplain mapping and programs, combined sewer overflows, and challenges of stormwater utilities will be explained. A detailed explanation of the National Flood Insurance Program will be provided, including its payouts, revenues, and challenges. You will be alerted to how stakeholders should respond to future issues.

  • Life member and fellow of the American Society of Civil Engineers, life member of the American Water Works Association and American Public Works Association, board of directors, 1992 - 1995, and former president of Fort Collins Water Board
  • Appointed by U.S. Supreme Court as River Master of the Pecos River, 1988 - present
  • Ph.D. degree in hydraulic engineering, Colorado State; M.S. degree in hydraulic/structural engineering, Auburn University; B.S. degree in engineering, U.S. Military Academy
