Tips for Calculating a Regular Rate of Pay For Your Employees

Wage and hour claims against employers have exploded in the last five years. One target is the rate of pay an employer pays to its nonexempt employees, and how that rate affects overtime payments. Most covered employers understand that they must pay overtime compensation at the rate of "time and a half" to nonexempt employees. But time and a half of what? Under the FLSA and most state counterparts, time and a half is based upon an employee's "regular rate" of pay. Thus, determining the "regular rate" of pay is critical to calculating the amount of overtime pay an employee is owed. Getting this wrong can have serious consequences.
