Investigating Sexual Harassment and Assault Claims Against Practitioners

Responding to reports of allegations of physician sexual misconduct is more important now than ever. After the rise of the #MeToo movement and public examples such as the former USA gymnastics national team doctor, Larry Nassar, and former USC gynecologist, George Tyndall, health care entities across the country are seeking to ensure they have the policies and procedures, and training, required to properly respond to such allegations. This topic helps the persons responsible for drafting and implementing such policies and procedures to understand the key components in appropriately responding to allegations in real time. This information will address the special aspects of investigating sexual harassment and sexual assault allegations against a practitioner who is an employee and a practitioner who holds privileges at a health care entity and/or is a hospital medical staff member. Under medical staff peer review, the protocols in responding to a complaint regarding an employee and a physician with privileges are not the same. This topic will address those differences and provide information how to operate with an understanding of those differences to maintain the peer review privilege and immunities for your health care entity.
