Who Gets the Animals? Companion Animal Custody and the Law

Understand pet ownership rights and custody battles through notable case studies.

Over the past fifteen years, the number of cases involving pet custody has grown significantly. The attention to the area highlights the changing public sentiment regarding attachment to companion animals, and the ends people are willing to go to in order to keep their animals, or to keep their animals away from their ex-spouse, ex-roommate, or ex-friend. The romantic notion of fighting for one's animal, however, often takes a back seat to addressing the legal issues that arise in these cases. Depending on the forum and, if in court, the judicial officer, the issues addressed will range from a straight ownership/property analysis, to a more contemporary best interests; examination. This topic will cover the various factual scenarios that may arise, and how they may present slightly different legal issues; discuss several cases addressing the issues and evaluate the courts' approaches; and provide a roadmap for causes of action to be brought in custody cases involving animals.
