Protecting the Rights of Posthumous Children

With our soldiers going on multiple tours of duty, they and anyone else of reproductive age are facing possible loss of capacity or terminal illness or accidental death, at a time when the current state of medical technology allows health care practitioners to intervene posthumously with respect to their reproduction. Also, bereft spouses and parents make demands for reproductive materials to which health care practitioners may not know how to respond in the absence of clear direction from their incapacitated, dying or dead patients.

Patients undergoing fertility treatment are uniquely situated to consider and state their wishes concerning their gametes, embryos, surrogacy, or other means of conception when they are no longer able to actively control those decisions. However, all persons of reproductive age should be aware that their desires with respect to becoming parents, if not clearly stated, may be determined by someone else at a time when they are unable to speak for themselves.

There needs to be awareness of legal requirements for person's wishes concerning posthumous reproduction, including who can control the gametes or embryos in questions, what can be done with them, and whether or not the resulting child will be considered a child of the patient's estate for inheritance purposes.
