New Developments in the Jury Selection Process

Gain an understanding on how background searches are expectations prior to the case to help better understand jurors.

Jury selection is different today than it was 10-15 years ago because of social media. Today, there is a wealth of information about some or most of the jurors in the venire that is readily available to attorneys who know how to look for it. The problem is attorneys must now learn how to identify this information and incorporate it into their decisions about which jurors to strike in what can be a very limited timeframe. Often, these searches must be conducted during the voir dire process, so information must be found and assimilated concurrently with other important tasks during the jury selection process. This topic will help you to understand some key legal rulings that pertain to social media and back-ground searches, as well as the expectations of attorneys in conducting these searches. How can you find information within such tight time constraints? What kind of preparation can you do up front that will help with conducting the searches; communicating the results; and identifying high risk jurors? How can this information best be shared between members of your trial team? And, most importantly, how can you use this information in conjunction with all of the other information that you learn during oral voir dire and/or on juror questionnaires? Learn how to assimilate information and how to use all of the information, from social media to voir dire responses, to rate prospective jurors and to help with cause challenges.
