Ethical Implications for Attorneys Transitioning to New Firms

Gain a better understanding of how to navigate ethical conflicts and other potential issues with clients and your new firm.

In today's legal market, attorneys frequently transfer between law firms. These lateral transfers create various ethical issues while considering and negotiating the transfer and then completing the transfer. One of the most significant issues with lateral transfers is the creation of conflicts between clients of the two law firms involved. The failure to recognize and resolve conflict issues before a lateral move can result in the disqualification of a law firm, which does not only harm the client but can also lead to the disgorgement of earned fees. Knowing the areas of potential ethical issues and how to structure a lateral move to void conflicts and other ethical issues will save a firm and clients from unnecessary harm and embarrassment. This topic is designed to alert the attorney to potential issues with lateral transfers and how to address them to avoid the consequences of an ethical violation and address the duties to the client when a lateral move occurs and how to deal with the client and the rights of the client.
