In-house counsel faces ethical challenges that other attorneys may not - learn and understand these special circumstances and how to handle them.
With increasing regulatory compliance and an ever- changing legal landscape, both foreign and domestic, in-house counsel face unique challenges in their multiple roles as business advisor, salaried corporate employee and legal counsel to the corporate client. In each of these roles, in-house counsel are required to conduct themselves in accordance with the rules of professional conduct, ensure the corporation complies with applicable laws and regulations and corporate policies and practices. This topic will explore some of the basic ethics issues faced by in-house counsel and how to deal with them or what to keep in mind as you analyze the situation, and cover, among other topics, the one client relationship, attorney-client privilege, reporting obligations, and how to navigate conflicting (and sometimes competing) loyalties. It is hoped that in-house counsels will complete this topic with a renewed appreciation for how to carry out their duties and some of the key ethical considerations you need to keep in mind as in-house counsel.
