Dynasty Trust Estate Planning Fundamentals

Gain an understanding of the different designs of trusts centered around Dynasty Trust.

Dynasty trusts are increasingly used in estate planning to achieve estate tax savings for multiple generations, while also providing creditor and divorce protection. This topic will review how to create a dynasty trust and how it should be designed for optimal access and protection from transfer taxes and creditors. Further, although the estate tax exemptions are in constant flux and with the current law providing an all-time high exemption, this material will review many of the nontax reasons a client should create a dynasty trust for his or her beneficiaries, and uses for dynasty trust even if there is no estate tax. Considerations that will be addressed include situs of the dynasty trust, specific elements of drafting for optimizing the benefits of a dynasty trust, and flexibility that can be incorporated to cope with changing laws and beneficiary circumstances.
