LGBT Employment Rights Update

November 18

Learn how to stay compliant with the evolving changes within the law of sex discrimination within the workplace.

Few areas of law change as often and as rapidly as employment law. In recent years, Americans have undertaken a fundamental reexamination of their understanding of gender, sexual orientation, and gender identity. This evolution in the ideas about gender continues to develop and is likely to bring about even more change in employment law. Courts and state legislatures have made some fairly recent pronouncements in this area, and the U.S. Supreme Court is positioned to decide some landmark cases in the upcoming term regarding the application of employment discrimination law to sexual orientation and gender identity. This topic will discuss how to identify and anticipate these issues and potential changes in the law and how to proactively prepare your business for compliance with this evolving understanding of sex discrimination. Reviewing and, where needed, modifying such things as hiring and disciplinary practices, employee policies, and workplace communication will be key to remaining compliant with the law as it develops, and this topic will address various ways to accomplish this.

Learning Objectives

  • You will be able to recognize potential shifts in the law of employment discrimination with regard to sexual orientation and gender identity.
  • You will be able to explain the framework of employment discrimination law and how sexual orientation and gender identity fit within that framework.
  • You will be able to discuss various changes in employment law that have recently occurred and that might occur in the next year or two with regard to sexual orientation and gender identity.
  • You will be able to identify proactive steps that you and your business can take to anticipate and comply with changes in employment law regarding sexual orientation and gender identity.
