A Creditor's Perspective: Understanding Chapter 13 Bankruptcy Procedures

Understand Chapter 13 procedures and gain better insight on the ramifications of a borrower seeking debt relief and reorganization.

A Chapter 13 bankruptcy allows a debtor with a regular monthly income to discharge and reorganize debt through a payment plan. A creditor who ignores the process does so at their peril. This course is designed to explain the Chapter 13 bankruptcy process, including Chapter 13 plan treatment and the plan confirmation process. Attendees will also learn more about bankruptcy litigation, including relief from the automatic stay, proof of claim and claims litigation, 363 sales, and cramdowns. The presentation also provides best practices for unsecured and secured creditors as they navigate the bankruptcy process.

Learning Objectives

  • You will be able to describe the general content and structure of Chapter 13 of the U.S. Bankruptcy Code.
  • You will be able to explain common disposition and liquidations of real and personal property and the sale, lease, or use of such property during the administration of the bankruptcy case.
  • You will be able to identify the various forms and types of creditors’ claims.
  • You will be able to discuss typical procedures involved in a Chapter 13 bankruptcy, including reorganization concepts, contents of a Chapter 13 plan, the plan confirmation process, and administration of the plan.
