The material will also review how to use promissory notes and guarantees and discuss what to do if the debtor is out of state. The speaker will help identify possible situations before suit and how to deal with the client with these unique situations. When litigation is pursued, creditors and their collection partners should always be aware of the risk of counterclaims, which can include breach of contract, fraud, and consumer-protection claims.
