 Discrimination laws

  • Title VII, Civil Rights Act of 1964 - prohibits discrimination, based on race, color, religion, sex, or national origin, in all aspects of employment - prohibits retaliation for exercising Title VII rights - covers employers of 15 or more employees.
  • Age Discrimination in Employment Act of 1967 - prohibits employment discrimination on the basis of age against individuals who are at least age 40 (no upper age limit) - prohibits retaliation for exercising statutory rights - covers employers of 20 or more employees.
  • Equal Pay Act - prohibits discrimination in pay based on gender for employees who perform the equal work on jobs the performance of which requires equal skill, effort and responsibility and performed under similar working conditions.
  • Americans with Disabilities Act - prohibits employers from discriminating in all aspects of employment against disabled individuals who are otherwise qualified for the job and who can perform the essential functions of the job with or without a reasonable accommodation - covers employers with 15 or more employees.
  • Genetic Information Nondiscrimination Act of 2008 - prohibits discrimination based on genetic information. Same definition of employer as Title VII.
  • Pregnancy Discrimination Act - requires that pregnant employees be treated the same as non-pregnant employees.
  • Civil Rights Act of 1991 - permits a successful plaintiff in an employment discrimination case to recover compensatory and punitive damages, and entitles plaintiffs to a jury trial.
  • Immigration Reform and Control Act - prohibits discrimination on the basis of citizenship.
  • Rehabilitation Act of 1973 - prohibits federal contractors or subcontractors or any program or activity receiving federal financial assistance from discriminating against disabled individual.
  • Civil Rights Act of 1866 - prohibits discrimination on the basis of race in contracting (hiring, promotion, terms and conditions of employment.
  • Civil Rights Act of 1871 - provides remedy against person acting under color of state law who deprives another of federally protected right and prohibits conspiracies, by private persons, to deprive another of equal protection and equal privileges and immunities under the laws.
