Website Accessibility Lawsuits under Americans with Disabilities Act on the Rise

 

Physical barriers, steps and narrow routes ADA lawsuits are giving way to business website accessibility.

For years, lawsuits under Title III of the Americans with Disabilities Act concerning places of public accommodation were confined to brick-and-mortar physical barriers, such as steps, excessive slopes in parking lots, and routes that were too narrow for individuals in wheelchairs to use. Now, in the e-commerce age, lawsuits complaining that businesses websites are not accessible to vision-impaired users in violation of Title III are on the rise. Joseph J. Lynett, Esq., is a senior associate at Jackson Lewis LLP and a member of the firm’s Disability, Leave and Health Management Practice Group, which assists employers in meeting the legal and practical challenges posed by federal and state laws protecting injured and ill employees. He is a graduate of Brooklyn Law School and received a B.A. degree from The University of Chicago. Maintaining an active counseling practice, Mr. Lynett provides imaginative and creative solutions to the complex array of workplace disability and health management issues faced by both large and small companies. He counsels clients with the goal of either avoiding litigation entirely or improving outcomes before administrative agencies, courts and juries. A significant amount of Mr. Lynett’s counseling involves assisting clients in conducting an individualized assessment required by a growing number of federal and state laws. These efforts include helping employers effectively communicate with employees and medical providers in an effort to evaluate potential risks to health and safety posed by employee injuries or illnesses. In an area of law in which there often are few bright lines, Mr. Lynett attempts to develop practical and constructive solutions.
