Transfers of real property are subject to the Statute of Frauds, a statute at common law which provides that no action shall be brought upon real estate contracts unless the agreement or some memorandum thereof shall be in writing and signed by the person sought to be charged or by his authorized agent.  Though the statutes vary considerably, all states have codified one or more versions of the Statute of Frauds.  This white paper reviews Statutes of Frauds and discusses the recording laws.
