Trespass, Nuisance and Privacy: More Questions Than Answers?

 

It's a fine line between the three when it comes to drone use.

Recent case law has not definitively drawn the line that divides trespass, nuisance and privacy from the right to use the sky to operate unmanned aircraft systems. However, case law from over seventy years ago might be worthwhile to dig into. This white paper reviews the old case law and how it plays a part in today’s trials.

Jeffrey K. Phillips, a member at Steptoe & Johnson PLLC, has tried lawsuits in federal and state courts for more than ten years. He is licensed to practice in the State of West Virginia and the Commonwealth of Pennsylvania. Mr. Phillips’ main practice area is defending law enforcement agencies and officers. Mr. Phillips has also handled a variety of general litigation matters, including claims of product liability, premise liability and negligence. He received his business management degree at Point Park College and his law degree at the University of Pittsburgh School of Law. Mr. Phillips is an active member of the West Virginia Defense Trial Counsel Association and the Defense Research Institute, in addition to being a member of the West Virginia and Pennsylvania Bar Associations. He is an instructor at the West Virginia State Police Academy and has co-authored a manual used by cadets at the Academy. In addition, Mr. Phillips has presented civil rights liability seminars to various state, county and city law enforcement agencies, and to other attorneys. He has also been sponsored by the West Virginia Municipal League, Sheriff’s Association, and Police Chief’s Association to speak to administrators, supervisors and officers. His presentations are accredited by the Division of Criminal Justice Services.
