State and Federal Issues and Developments in Fair Lending

 

There may be more attention paid to credit underwriting practices that take into account an applicant’s or borrower’s immigration status.

A recent court case was left with the court refusing to dismiss certain federal and state credit discrimination claims arising from the alleged practice of denying credit to individual applicants who are authorized to work in the U.S. pursuant to the DACA 2012 Executive Order.
