Methods of modifying irrevocable trusts.

If the trust agreement does not provide the now preferred provision, there are means to modify its provisions. But not all methods are available, and some are dangerous for purposes of estate tax. As seen above, modifying the trust to avail one of a more favorable state’s trust and other law may be profitable. There are now many ways to amend, and even revoke, unamendable irrevocable trusts. The white paper discusses some of them by organizing them based on who may have the power of effect the modification.
