The Seventh Circuit Debates Statutory Interpretation
The Seventh Circuit recently decided that the ADEA doesn’t support bringing about action for outside job applications based on a disparate impact theory. Besides the result, the court was strongly divided regarding how the statutes should be interpreted. This white paper reviews the division in opinions in this case.
