New OSHA Rule Will Make Employer-Specific Injury and Illness Data Publicly Available

In an effort to further prioritize workplace safety around the country, the Occupational Safety & Health Administration (OSHA) has revised its Recording and Reporting Occupational Injuries and Illnesses regulation to require the electronic submission of illness and injury data which will then be posted on a publicly-accessible website. The new rule also updates the requirements for how employers must inform their employees about reporting work-related injuries and illnesses and their right to do so free from retaliation. OSHA believes these changes will lead to more accurate records and reports and that the public accessibility of this information will incentivize employers to further refine and focus on their workplace safety efforts.

Beginning July 1, 2017, certain employers must electronically submit injury and illness data that they already record on OSHA Forms 300 (Log of Work-Related Injuries and Illnesses), 301 (Injury and Illness Incident Report), and 300A (annual Summary of Work-Related Injuries and Illnesses). OSHA intends to post individual employer's injury and illness data on its public website at www.osha.gov because it believes that doing so will encourage employers to improve workplace safety while providing valuable information to workers, job seekers, customers, researchers and the general public.
