Negotiating Termination for Convenience Clauses in Construction Contracts

Termination for convenience can happen for various reasons.

When preparing to start work on a new construction project, termination is often one of the last thoughts on the parties’ minds and, as such, is often given little attention in the contract drafting and negotiation stage. In the current real estate construction market, however, contract termination is a real possibility that cannot be ignored given the uncertainties that can arise in even the best thought out construction project.
