How do you resolve discrepancies?
The survey and the commitment for title insurance, at a basic level, offer two parallel versions of the same subject matter. The survey typically describes, refers to or portrays the physical improvements, lines of occupation, buildings, structures, and, in some cases, terrestrial vegetation, in relationship to the property description found it the chain of title culminating in the latest deed that was recorded. The title insurance commitment, in contrast, typically describes, refers to or identifies the name of the title holder/owner, liens, defects and encumbrances that were discovered from a search and examination of the public land records. This white paper reviews what happens in the event that comparison of the survey and the commitment for title insurance result in conflicting viewpoints or opinions.
