Illinois Construction Lien Law: Enforcing a Mechanics Lien

 

A contractor or subcontractor may file a lawsuit to foreclose its mechanics lien. In both cases, all parties who may have an interest in the property should be named in the lawsuit, including the owner, mortgage lenders and other lienholders. The general contractor also may sue the owner for breach of contract, and the subcontractor may sue the general contractor for breach of contract. The subcontractor cannot sue the owner for breach of contract because the subcontract is not with the owner.
