Gain insight into using emails in collections.
Regulation F allows attorneys to contact consumers by text and email. Emails are restricted to nonwork addresses. This may be difficult to recognize as many Gmail accounts can be both personal and work emails. Reg F does give guidance to debt collectors as to how to claim a bona error defense when using email. This white paper reviews how debt collectors must have procedures to confirm and document that they did not communicate with consumers via email that has led to a prohibited third-party disclosure and also discusses when Reg F allows a debt collector to use an email address.
