Eviction Proceedings in New York

 

No rule is immune to exceptions as some court cases proved.

Historically, landlords were relegated to the protracted, common law action of ejectment to remove persons who were in possession of their property without their permission or authorization. Over time, legislatures enacted statutory schemes to provide a more simplified, speedy and inexpensive remedy to recover possession of real property. This white paper reviews two types of landlord-tenant summary proceedings, and ejectment actions in the Supreme Court.
