Property descriptions may include drafting pitfalls with lasting impacts. It is the drafting of deeds and mortgages destined for recordation in the public land records to effectuate the formal transfer of the title of the grantor or creation of a security interest of the mortgagor that transfers with a high degree of precision the title to the land of the grantor or mortgagor, or alternatively, unintentionally either leaves remnants of the land in the grantor or purports to convey more land than the grantor owned, thereby overlapping the land of the adjoining owners.
