Failure to follow the change order process entitles a party to abandon the contract.

The construction contract will generally provide the procedure for change orders and the AIA General Conditions provide pertinent provisions regarding change orders. The claim process regarding change orders is discussed in many cases with the general rule being if the contract requires change orders for payment, then a change order must be obtained.
