As-of-Right Transfers By Zoning Lot Merger


ZLDA issues should be considered.

If a proposed development complies with the requirements of a zoning resolution and other applicable laws, then the Department of Buildings is required to issue a building permit for the development. The issuance of a building permit for an as-of-right development is a ministerial act, subject to mandamus and not subject to environmental review requirements.
