Under HIPAA criminal penalties may apply to employees of covered entities or other individuals who obtain, use, or disclose protected health information (PHI) without authorization. Civil fines and penalties are meant to redress wrongs by compelling restitution or prevent further harm. Criminal fines, penalties and imprisonment are to punish the wrongdoer and deter future wrongdoing and may include going to prison. This video reviews who may be prosecuted for HIPAA violations and discusses elements of a HIPAA crime.
