Before paying overtime the regular rate of pay needs to be determined.
Under the regular rate of pay the FLSA applies on a workweek basis. Unless specifically exempted, employees that are covered by FLSA must receive overtime pay for hours worked in excess of 40 hours in a work week at a rate of time and a half of their regular rate of pay.
