Subcontractors, and subcontractors of subcontractors, are parties that create, receive, maintain or transmit protected health information on behalf of business associates. Business associates are obligated to enter into business associate agreements with their subcontractor-business associates which must pass down any additional non-HIPAA required obligations agreed to between the covered entity and the business associate.
