What occurs when there is a HIPAA data breach?
Possible penalties after a HIPAA data breach fall into two main categories – civil penalties and criminal penalties. Civil monetary penalties (CMPs) are based on a tiered civil penalty structure depending on the level of culpability as determined by the Secretary of HHS. The OCR can refer HIPAA violations to the Department of Justice and directors, officers or employees could be deemed criminally liable with different levels of severity depending on the level of culpability. This video reviews the possible penalties involved and discusses the effects of reputational harm.
