What proposals for change are in the works?
The treatment of interns under the FLSA has been in the spotlight in recent years. If you have been following this area of law you may recall a recent class action with interns on a recent movie. The Department of Labor standard determines interns be given training similar to training in an educational environment and it should be for the benefit of the intern and no advantage to the employer. There also needs to be a mutual understanding that the intern will not be paid. Our speaker reviews this standard for determining whether an intern is an employee, and discusses future changes.
