Overview of Contracting Process

The contracting process includes four main areas – preliminary activities, contract negotiations, post-contract activities and winding down or transitioning the relationship. Preliminary contract activities can seem relatively straight forward however in the overwhelming majority of transactions our speaker sees, business do not pay sufficient attention these activities. The use of RFP/RFQ/RFIs or even seeking bids has fallen by the wayside which can dramatically reduce the customers negotiating leverage. With contract negotiations having a single voice for your company is very important. All too often vendors will try and go around the front person in the negotiation if they aren’t getting their way. Having a single unified voice will help you maintain your company’s leverage.

In this 9-minute video our speaker, Michael R. Overly, discusses post-contract and winding down activities including security compliance. He also reviews the importance of developing alternate suppliers and preparing a contingency plan as part of your business continuity and disaster recovery planning.
