Construction contract requirements start with the basics. There must be an offer, there must be acceptance and there must be consideration for any construction contract to be valid. This also applies to amendments or modifications to a contract. Breach elements occur with the existence of a valid and enforceable contract, performance by the plaintiff, breach of contract by the defendant; and resultant injury to the plaintiff.
