OFCCP's Monitoring Adherence to Internet Applicant Rule

 
Many of you may have experienced an audit from the OFCCP to determine if you are adhering to the myriad of regulatory requirements found in the affirmative action regulations including the obligation to record applicant data. The OFCCP has tools in its evaluation scheme to ensure that employers are doing what they are supposed to be doing in this regard. OFCCP audits likely go wrong because of applicant issues more often than all other issues combined. The OFCCP generally won’t challenge the employer’s definition of applicant at the outset but these three red flags will get their attention: low applicants-to-hires ratios; high percentage of applicants for whom race or gender is unknown; and makeup of applicant data by race, ethnicity and gender.
