Legislative Update, Economic Nexus, Click-Through Nexus and What's Next

 
This 9-minute video includes a legislative update on nexus. Our speaker, John P. Barrie, reviews click-through nexus legislation and New York, Colorado and Illinois cases where they adopted similar legislation. He explains that from a policy standpoint tax administrators feel that due to the overall presence of internet sales that states should be allowed to collect tax on those sales but feels there needs to be a dollar threshold. This is the pairing of economic nexus and gross receipts. Mr. Barrie continues on with a discussion on handling nexus assertions and how nexus can affect your business model.

John P. Barrie is a partner in the Washington and New York offices of Bryan Cave LLP. His practice focuses solely in the areas of federal and state tax controversy and transactional matters. Mr. Barrie regularly represents taxpayers in state sales/use tax and state income tax controversy matters. His transactional practice includes providing tax advice to public and private businesses in taxable and tax-free mergers, acquisitions, reorganizations, spin-offs, divestitures and restructurings.
