Issues In Individual Access of Records Under HIPAA

 

Review new emphasis on enforcement of individual access rules.

Is it important to manage access of records properly? Yes, it is one of only two circumstances when PHI must be released, per Privacy Rule §164.502(a) Yes, based on enforcement actions - there was a practice group that was given a $4.3 million fine because they did not provide records as requested by individuals and did not respond to HHS investigators. Yes, in 2016 audits three of the top five privacy issues were access related. And yes, it is one of the issues involved with data blocking and working to improve the flow of patient information between providers. This video reviews these issues and business associate liability for HIPAA compliance.
