What happens when the IRS tells you your employee is misclassified?
Common law standards and factors apply when examining whether a payee is an employee or independent contractor. However, under some Federal legislation, economic reality factors are inserted, with presumptions of employment applying, because of a remedial purpose inherent in the legislation. States are moving toward the ABC test, where presumptions of employment are stronger. This video reviews issues surrounding employees vs. nonemployees, Section 530, Section 7434 and the fraudulent Form 1099-NEC, and other developments.
