How to Use Voluntary Disclosure Programs to Resolve Nexus Issues

 

Voluntary disclosure money is found money so state voluntary disclosure units tend to give taxpayers the benefit of the doubt.

Noncompliant taxpayers can come forward voluntarily and pay taxes accrued during a limited lookback period. However, noncompliant taxpayers must be accepted into the voluntary disclosure program. The nexus rules are changing quickly. Those accepted into the voluntary disclosure program avoid the threat of criminal prosecution, avoid taxes imposed before the lookback period, avoid failure-to-pay and failure-to-file taxes normally imposed, in certain states they can avoid interest on taxes and penalties, and anonymity as the taxpayer may remain anonymous until they sign the settlement agreement with the state.
