If there is a connection between the trust property and the trustee’s personal account or property, a trustee is in breach of his duty of loyalty, regardless of good faith or fairness to the beneficiary. Conflict of interest is irrebuttably presumed – sometimes called “no further inquiry rule.” Transactions effected by a conflict between the trustee's personal interest and the interests of the beneficiaries are voidable. This video reviews the trustee’s duty of loyalty and impartiality, and the duty to inform and report.
