Gain knowledge on why a severability clause might be necessary for your next contract.
In some ways a severability clause might be looked at as one of the most mundane of the clauses that you might find at the end of a contract. This type of clause basically states that if a court of confidant jurisdiction finds any provision of the contract to be unenforceable the parties agree that it will be excised from the contract and that the rest of the contract remains enforceable. When the parties agree to this type of clause in the contract allowing the courts to excise certain unenforceable provisions, they are saving themselves from the potential of headaches down the road. This video reviews this type of clause and discusses how the law varies from state to state regarding what a court will do.
