Bankruptcy Considerations and Miscellaneous Clauses

 

Avoid Preferences

Loan modifications may require additional guarantors, additional collateral, or previously granted security interests to be properly perfected. If a bankruptcy is filed within 90 days of the loan modification, such additional rights may be set aside as a “preference,” unless the lender’s forbearance is deemed sufficient to be a concurrent exchange of new value. This video reviews different bankruptcy considerations and miscellaneous clauses.
