Understanding Pennsylvania's Public Contracts and Procurement Regulations

 
Know the unanticipated issues you may face when submitting bids for contracts in Pennsylvania.Many contractors do not understand the procurement and bidding process under which government contracts are awarded in Pennsylvania. Once awarded a contract, many contractors and contract administrators often are not fully aware of the strict rules which govern the timely payment of contractors, subcontractors and suppliers on government project or on projects which receive government funding. Finally, the recent enactment and implementation of the Public-Private Transportation Partnership (P3) Act, 74 Pa. C.S. §9101-9124, has already begun to revolutionize the way that the government delivers public transportation infrastructure in an era of limited government funding, and creates exciting opportunities for those private sector partners able to capitalize on its provisions.
This topic explains in plain English for contractors, lawyers and contract administrators the procurement process on public projects in Pennsylvania, and explains the situations likely to result in bid challenges. This topic then explains how the new P3 statute upends that traditional public bidding model, and creates unprecedented entrepreneurial opportunities for private-sector partnership with the public agencies and permits the sort of integrated project delivery approaches seen on many private projects. The topic also explains how public-sector contractors and subcontractors can make sure they are being paid timely, and the potential consequences for the failure to adhere to these required payment procedures. Finally, this topic deals with contractor ethics issues and explores the pitfalls (such as potential debarment) that can arise under the contractor integrity provisions commonly included in government contracts.
