Learn about the challenges and legal issues associated with soil defect.

Many property owners, lessees, architects, engineers, developers and contractors encounter soils defects on residential, commercial, retail and industrial properties. However, these persons are usually not trained on how to evaluate the legal, technical and budgetary risks posed by soils defects. It is important to understand how the presence of soils defects can impair the ability to sell, lease, refinance or redevelop impacted sites. Moreover, it is equally important to be aware of the options available to remediate and repair impacted sites, as well as the options available to them to mitigate the risks of purchasing or redeveloping sites with soils defects. Finally, persons involved in the redevelopment of property with geotechnical issues must understand the potential regulatory reuse restrictions, engineering controls and financing restrictions that can affect the future property uses. This information will inform participants about the problems facing them, complications caused by soils defects, and how to develop a protective and cost-effective purchase and redevelopment strategy.
