The Benefits of Blend and Extend

 
During the recession, commercial real estate industry landlords and tenants sometimes endured, and sometimes benefited from blend and extends - reducing tenant’s rate per square foot in consideration of extended term. With recovery now in sight in some markets, and continuing in others, how are tenants, attorneys, property managers, leasing agents and asset managers to treat tenancies requiring additional blends and extends, or coming out of blend and extends?

This slide deck will offer participants practical, legal and example-based direction on this topic. Key concepts will cover identifying blend or pretend and extends; drafting and enforcing clawback language; the importance of enforcing confidentiality agreements; re blending for some tenants in true need; incorporating noneconomic terms; and evaluating impact to asset value.
