Wage and hour lawsuits have cost employers tens of millions of dollars over the past several years and show no sign of slowing down. In many instances, these lawsuits could have been avoided, or dismissed on summary judgment, had the employer maintained the necessary payroll, time, and personnel records. This topic will identify record keeping requirements under the Fair Labor Standards Act and discuss various areas of the law that are impacted by the failure to maintain necessary records.
