Mineral Rights: Current Issues and Legal Concerns

 
Learn about the latest issues and complexities associated with mineral leases and contracts.As drilling technology improved and increased over the recent years, the number of oil and gas producing states have grown from the early discovery in 1859 in Pennsylvania and the boom years that followed in California, Texas, Louisiana, Oklahoma and other states. By 2014, most of the onshore oil and gas production comes from Texas, North Dakota, California, Alaska, New Mexico, Oklahoma, Colorado, Wyoming and Louisiana. The surge continued in those states and other states due to hydraulic fracturing (fracking). The number of oil and gas discoveries, have caused states to look at the legal concepts of the ownership of hydro-carbons, the exploration and development of reserves. Many states have over the years devised laws, rules and regulations to address such issues. While there are unique legal principles in those states (especially in Louisiana which adopted the Civil Law system as opposed to the Common Law system), there are nonetheless many common industry practices and customs in the negotiation of mineral leases and associated contracts. This topic will highlight those basic legal concepts and its applications in those oil and gas producing states.
