Legal and Practical Issues of Illinois Easements

Understand how easements address the issues of a right to use real property and help prevent real property conflicts.

Often owners and users of real property need to give permission to use a property that does not require outright ownership of a parcel. A seller may wish to preserve certain uses of a parcel of property by the seller after transfer to a buyer. Neighboring property owners may wish to allow each other to use each other’s parcel under an agreement allowing certain uses but prohibiting others. This topic will familiarize real estate practitioners and professionals with how easements may address the issues of a right to use real property without owning a parcel outright. Further, this material will provide insight into tools to prevent real property conflicts before they arise. Also, you will learn the effects of easements and other agreements on disputes that arise after the parties discover a conflict in property use.
